Terms and Conditions
Effective date: September 21, 2026
These Terms and Conditions (the "Terms") govern access to and use of https://fintax.cc and any related webpages, forms, accounts, checkout functions, communications, and online features (collectively, the "Site"). They also establish general conditions applicable to services requested through the Site.
In these Terms, "we," "us," and "our" mean fintax.cc, doing business as FinTax, with its principal place of business in Florida, and a mailing address at 2875 S Orange Ave, Ste 500, No. 6052, Orlando, Florida 32819. "You" and "your" mean each visitor, prospective client, client, or other person who accesses or uses the Site.
By accessing or using the Site, creating an account, submitting a form, scheduling a service, or purchasing a service, you acknowledge that you have read and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site. If you use the Site for a business or another person, you represent that you are authorized to bind that business or person.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Site or purchase services. You may not use the Site if doing so would violate applicable law.
2. Website Information Is Not Professional Advice
Site content is provided for general informational and educational purposes only. It is not tax, accounting, audit, legal, investment, insurance, lending, or other professional advice and should not be relied upon as a substitute for advice tailored to your circumstances.
Tax laws, filing requirements, agency guidance, deadlines, and financial conditions change. Site content may be incomplete, outdated, or inapplicable to your facts. No statement on the Site creates a guarantee, warranty, safe harbor, or professional opinion.
You are responsible for obtaining advice from appropriately licensed professionals before acting or declining to act based on Site content.
3. No Client Relationship Through Website Use
Accessing the Site, submitting an inquiry, uploading a document, communicating with FinTax, or paying an initial amount does not by itself create an accountant-client, tax preparer-client, fiduciary, advisory, or other professional relationship. A professional relationship begins only when FinTax and the client accept a written engagement letter, statement of work, service order, or other written agreement that identifies the client and scope of services (an "Engagement Agreement"), and any required payment and onboarding conditions have been satisfied.
FinTax may decline any engagement in its discretion, including because of capacity, conflicts, missing information, licensing limits, risk, or inability to verify identity.
4. Scope and Order of Precedence
Services may include tax preparation, tax planning, bookkeeping, accounting support, financial statement preparation without assurance, fractional finance support, startup accounting, international tax support, and related consulting, but only as stated in an Engagement Agreement.
Unless an Engagement Agreement expressly states otherwise:
- FinTax does not provide legal opinions, legal representation, investment management, securities recommendations, insurance placement, attest services, audits, reviews, compilations, assurance, or services requiring a license FinTax or the assigned professional does not hold.
- FinTax is not responsible for services outside the agreed scope or for monitoring legal, tax, filing, or payment deadlines after the engagement ends.
- Any additional work, change in facts, additional jurisdiction, late or disorganized records, agency notice, audit, appeal, amended return, bookkeeping cleanup, or expedited request may require a revised scope and additional fees.
If these Terms conflict with an Engagement Agreement, the Engagement Agreement controls for the professional services covered by that agreement. The Privacy Policy controls with respect to personal information. A separate legally required consent, including a consent under Internal Revenue Code Section 7216, controls over any inconsistent general language in these Terms.
5. Client Responsibilities
You agree to:
- provide complete, accurate, legible, and timely information and documents;
- review all returns, reports, filings, elections, payment instructions, and deliverables before approval or use;
- promptly disclose changes, notices, foreign accounts or assets, digital assets, ownership interests, related-party transactions, income, deductions, credits, residency, and other material facts;
- maintain original records and supporting documentation;
- safeguard your account credentials and promptly report suspected unauthorized access;
- make all tax and government payments directly and on time unless a written Engagement Agreement expressly assigns another process; and
- make final management, business, and financial decisions.
FinTax may rely on information you and your authorized representatives provide without independently auditing or verifying it unless the Engagement Agreement expressly requires verification. You remain legally responsible for the accuracy and completeness of your filings and for the positions you authorize, even when FinTax prepares or submits them.
FinTax is not responsible for penalties, interest, lost deductions or credits, missed deadlines, filing rejection, or other consequences caused by inaccurate, incomplete, late, withheld, or changed information; your delay or failure to review or approve; your failure to pay an authority; an agency or third-party system; or events outside FinTax's reasonable control.
6. Estimates, Deadlines, and Tax Outcomes
Quotes and time estimates are based on the information then available and are not guarantees. FinTax may revise a quote or timeline if the facts, scope, law, records, or client responsiveness differ from what was initially represented.
FinTax does not guarantee a refund, credit, deduction, tax savings, filing date, financing result, agency acceptance, audit result, or any other outcome. Taxing authorities may examine, adjust, reject, or challenge a return or position. Unless expressly included in an Engagement Agreement, responding to an examination, notice, audit, or appeal is a separate service.
Any completion date is contingent on timely receipt of complete information, approvals, signatures, authorizations, and payment. FinTax may recommend an extension when information or time is insufficient. An extension of time to file generally does not extend the time to pay.
7. Fees, Payment, and Refunds
Fees, deposits, billing schedules, taxes, and third-party costs will be stated in the applicable Engagement Agreement, proposal, invoice, checkout page, or service order. Unless otherwise stated, invoices are due upon receipt.
You authorize FinTax and its payment processors to charge the payment method you provide for amounts you approve. You are responsible for valid payment information and any taxes or charges imposed on your purchase, excluding taxes on FinTax's net income.
FinTax may pause or decline work for nonpayment, disputed payments, or failure to provide required information. Past-due amounts may accrue lawful collection costs or interest only if disclosed in an Engagement Agreement or invoice and permitted by law.
Our Refund Policy is incorporated into these Terms. If an Engagement Agreement contains different refund or cancellation terms for a particular service, that agreement controls.
8. Communications and Electronic Transactions
You consent to receive service-related communications electronically, including by email, portal message, telephone, or text at the contact information you provide. This consent covers transactional communications, not marketing messages where separate consent is required by law. Carrier rates may apply to text messages.
Electronic signatures, approvals, and records may be used to the extent permitted by law. You are responsible for maintaining current contact information and reviewing communications promptly.
Ordinary email, website forms, and consumer messaging applications may not be appropriate for Social Security numbers, tax returns, bank credentials, identity documents, or similarly sensitive information. Do not send sensitive tax or financial records through those channels unless FinTax specifically directs you to an approved secure method.
9. Confidentiality and Tax Return Information
FinTax will handle client information in accordance with applicable law, professional obligations, the Privacy Policy, and the applicable Engagement Agreement.
Federal law restricts a tax return preparer's use and disclosure of tax return information. Where Internal Revenue Code Section 7216 and its regulations require specific consent, FinTax will request a separate consent that meets applicable requirements. Acceptance of these Terms or the Privacy Policy is not a substitute for a separate consent when one is legally required.
FinTax may use employees, affiliates, contractors, and service providers, including personnel located outside the United States, only as permitted by applicable law and any required client consent. Access must be limited to legitimate service needs and subject to appropriate confidentiality and security obligations.
10. Accounts and Acceptable Use
You may not:
- access or use the Site for unlawful, fraudulent, abusive, or deceptive purposes;
- impersonate another person or misrepresent your authority;
- submit malicious code or attempt to bypass authentication, security, or access controls;
- scrape, probe, overload, disrupt, reverse engineer, or interfere with the Site;
- upload content that infringes another person's rights or contains information you are not authorized to provide; or
- use the Site to transmit another person's sensitive information without lawful authority.
You are responsible for activity under your account. Notify FinTax promptly at info@fintax.cc if you believe an account or communication has been compromised.
11. Intellectual Property
The Site and its text, design, graphics, logos, software, downloads, and other content are owned by or licensed to FinTax and are protected by applicable intellectual property laws. FinTax grants you a limited, revocable, nonexclusive, nontransferable right to use the Site for lawful personal or internal business purposes.
You may not copy, sell, publish, distribute, modify, create derivative works from, or commercially exploit Site content without prior written permission, except as permitted by law.
Client ownership and permitted use of a professional deliverable will be governed by the applicable Engagement Agreement. FinTax retains its preexisting methods, templates, know-how, tools, software, and working papers unless expressly agreed otherwise.
12. Third-Party Services and Links
The Site may link to or interoperate with third-party platforms, payment processors, scheduling tools, messaging services, tax software, e-file providers, hosting services, social networks, or client portals. Third parties operate under their own terms and privacy practices. FinTax does not control and is not responsible for third-party content, availability, security, decisions, or acts, except to the extent applicable law provides otherwise.
A link, integration, or reference does not constitute an endorsement or warranty. You are responsible for reviewing third-party terms before using those services.
13. Testimonials and Marketing Statements
Testimonials, reviews, examples, illustrations, and descriptions of prior outcomes reflect individual experiences or general scenarios. They do not promise that you will obtain the same or any particular result.
No Site statement should be interpreted as a promise of perfect accuracy, complete security, every available deduction, a specific tax outcome, or error-free or uninterrupted service. Any express service commitment must appear in an applicable Engagement Agreement.
14. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL GENERAL INFORMATION ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE." FINTAX DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES CONCERNING THE SITE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, SECURITY, AVAILABILITY, AND ERROR-FREE OPERATION.
FinTax does not warrant that the Site will be uninterrupted, secure, current, or free from harmful components. Nothing in this section disclaims a duty or warranty that cannot lawfully be disclaimed or alters an express obligation in an Engagement Agreement.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINTAX AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY; OR THE COST OF SUBSTITUTE SERVICES ARISING FROM OR RELATED TO THE SITE OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
FOR A CLAIM ARISING SOLELY FROM USE OF THE SITE OR GENERAL SITE CONTENT, THE AGGREGATE LIABILITY OF FINTAX AND THE FOREGOING PERSONS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID THROUGH THE SITE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. LIABILITY ARISING FROM PROFESSIONAL SERVICES IS GOVERNED BY THE APPLICABLE ENGAGEMENT AGREEMENT.
These limitations do not apply to fraud, willful misconduct, gross negligence, or any liability that cannot lawfully be limited. Some jurisdictions do not permit certain exclusions, so portions of this section may not apply to you.
16. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless FinTax and its owners, officers, employees, contractors, and agents from third-party claims, liabilities, losses, and reasonable costs arising from your unlawful use of the Site, your material breach of these Terms, content you submit without authority, or your fraud or willful misconduct. This obligation does not require you to indemnify a protected party for that party's own negligence, professional malpractice, violation of law, or willful misconduct.
17. Suspension and Termination
FinTax may restrict or terminate Site access if it reasonably believes you violated these Terms, created a security or legal risk, failed to pay an undisputed amount, or misused the Site. Termination of professional services is governed by the applicable Engagement Agreement.
Provisions that by their nature should survive termination will survive, including provisions concerning payment, confidentiality, intellectual property, warranty disclaimers, liability, indemnification, disputes, and governing law.
18. Dispute Resolution and Arbitration
Please read this section carefully. It affects the forum in which disputes are resolved.
18.1 Informal Resolution
Before filing a lawsuit or arbitration, the complaining party must send a written notice describing the dispute, relevant facts, requested relief, and contact information. Notice to FinTax must be sent to info@fintax.cc and the mailing address listed below. The parties will attempt in good faith to resolve the dispute for at least 30 days after receipt of notice. A party may seek urgent temporary relief when necessary to prevent immediate harm.
18.2 Binding Individual Arbitration
Except for an eligible individual claim filed in small claims court and a claim seeking temporary or injunctive relief to protect confidential information or intellectual property, any dispute arising out of or relating to the Site, these Terms, or a purchase made through the Site will be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules for a consumer dispute or Commercial Arbitration Rules for a business dispute. The Federal Arbitration Act governs this arbitration provision.
The arbitration may occur by video, telephone, documents, or in Orange County, Florida, as the applicable rules permit. FinTax will pay fees it is required to pay under applicable law or the administrator's rules. The arbitrator may award any individual remedy available in court but may not combine claims of different persons.
YOU AND FINTAX WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION OR ARBITRATION, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
18.3 Arbitration Opt-Out
You may opt out of Section 18.2 by sending an email to info@fintax.cc within 30 days after you first accept these Terms. The notice must state your full name, mailing address, email address, and a clear request to opt out of arbitration. Opting out will not affect the other Terms.
18.4 Engagement Agreements
If an Engagement Agreement contains a dispute-resolution provision, that provision controls disputes arising from the professional services covered by that agreement.
19. Governing Law and Court Venue
Florida law governs these Terms without regard to conflict-of-law rules, except that the Federal Arbitration Act governs Section 18. Any dispute that is not subject to arbitration must be brought exclusively in the state courts located in Orange County, Florida, or the United States District Court having jurisdiction over Orange County, and each party consents to personal jurisdiction there.
Mandatory consumer protections that apply in your place of residence are not waived to the extent they cannot lawfully be waived.
20. Changes to the Site or Terms
FinTax may change the Site and may update these Terms. The updated Terms will be posted with a revised effective date. Material changes will apply prospectively after reasonable notice where required by law. Your continued use after the effective date constitutes acceptance to the extent permitted by law.
21. Events Outside Reasonable Control
Except for payment obligations, neither party is responsible for delay or failure caused by circumstances beyond its reasonable control, including natural disasters, severe weather, fire, epidemic, war, terrorism, civil disorder, labor disruption, utility or telecommunications failure, cyberattack not caused by a failure to use legally required safeguards, government action, tax-authority or e-file system outage, or a third party's failure. The affected party will use reasonable efforts to reduce the effect of the event and resume performance.
22. General Terms
These Terms, the Privacy Policy, the Refund Policy, and any applicable Engagement Agreement constitute the relevant agreement between you and FinTax regarding their respective subject matter. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without FinTax's written consent. FinTax may assign these Terms in connection with a merger, reorganization, sale of substantially all assets, or by operation of law.
